MecaMap Terms and Conditions

This is a translation of the Spanish original, Términos y Condiciones. In case of any discrepancy, the Spanish version prevails.

These Terms and Conditions govern the use of the MecaMap app (com.asperor.mecamap) and the related services available at asperor.com/mecamap. By creating a company on MecaMap or joining one, you accept these terms. If you register a company, you declare that you are authorised to accept them on its behalf.

2. What MecaMap is

MecaMap is a professional tool for facility maintenance teams. It lets you record the equipment in a building or plant with its photo, its location, the breaker or shut-off valve that cuts it, its full circuit and the relationships between items, and look them up from a phone. It is intended for use by companies and professionals.

MecaMap is not a safety system. The information is entered by the users themselves and may be incomplete, out of date or wrong. It does not replace the official drawings of the installation or safe working procedures. Before working on any electrical, water, gas or other installation, always check on site that it is de-energised or depressurised, following the applicable regulations (in Spain, among others, Royal Decree 614/2001 and its "five golden rules").

3. Accounts, company and roles

The administrator creates the company account and receives a 6-character access code to share with their team.
Employees sign up with that code. The administrator decides who to approve and which zones each person can access.
The company, through its administrators, is responsible for who has access to its data and for removing access from anyone who stops working with it.
Each person must use their own account, provide accurate information and keep their password secret. If you suspect someone has accessed your account, let us know.

4. Subscription and payment

MecaMap is subscribed to per company, not per user: the subscription costs €35 a year (the final price, including any taxes that apply in each country, is the one shown by Google Play at the time of purchase) and gives access to all approved users of that company.
The subscription is purchased by a company administrator through Google Play. Billing, automatic renewal, cancellation and refunds are handled by Google Play under its own terms. You can cancel the renewal at any time from Google Play; the subscription stays active until the end of the period already paid for.
If the subscription is not active, access to the company's data from the app is blocked until it is renewed. The data is not deleted for that reason; the company can ask for it to be deleted at any time (see section 9).
We may offer free periods or promotions (for example, the first year free for the first companies). They apply under the conditions we announce in each case.
If the price changes, we will give advance notice through Google Play, according to its rules, and the new price will apply from the next renewal.

5. Company data and content

The content entered in MecaMap (equipment, photos, locations, circuits, notes) belongs to the company. You only grant us the permission needed to store it, protect it and show it to your company's approved users.
The company is responsible for making sure that content is lawful and for not including unnecessary personal data in photos or notes.
If a user's account is deleted, what they recorded is kept as company information but is no longer linked to their name.
The processing of personal data is explained in the Privacy Policy.

6. Acceptable use

When using MecaMap, you agree not to:

Try to access other companies' data or zones that have not been assigned to you.
Try to damage, overload or decompile the service, or get around its security measures.
Enter illegal content or content that infringes third parties' rights.
Use the service for purposes other than managing facilities.

7. Service availability

We work to keep MecaMap available and working well, but it is provided "as is" and we cannot guarantee that it will always work without interruptions or errors (for example, during maintenance or because of connection problems). We recommend not relying solely on MecaMap for your installation's critical information.

8. Limitation of liability

We are not responsible for decisions made or work carried out based on information entered in MecaMap by users (see the notice in section 2).
To the extent permitted by law, our total liability to a company shall not exceed the amount that company has paid for MecaMap in the 12 months before the event giving rise to it.
Nothing above limits any liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence.

9. Leaving, suspension and deletion

Any user can delete their account from the app (Profile → Delete account) or from this page.
To delete all of a company's data, an administrator can ask for it by writing to stefanradilov@gmail.com.
We may suspend or close accounts that break these terms, giving notice beforehand where possible.

10. Intellectual property

The MecaMap brand, its logo, the app design and its code are the property of Stefko Radilov. They may not be reproduced, distributed or used without express permission.

11. Changes to these terms

We may update these terms to reflect changes in the service or in the law. When we do, we will change the date at the top. If the changes are significant, we will notify each company's administrators by email or in the app at least 15 days in advance. Continuing to use MecaMap after that period means you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the Courts of Tarragona (Spain), unless consumer protection law requires a different mandatory jurisdiction.
